Terms of Use, Sale and Protection of Personal Information on the TATADOLLS Website

1. General

The TATADOLLS website, hereinafter the “Website”, is operated by Ouliana Spynou and offers handmade textile dolls, soft toys, doll clothing, accessories, sets and other handmade textile products.

The Website may also display sewing patterns, creative content, articles, photographs, tutorials and links to TATADOLLS products or services offered on third-party platforms.

Browsing the Website, creating an account, submitting information, placing an order or using any service available through the Website is subject to these Terms.

Before placing an order, the customer should read these Terms and the separate Shipping & Returns Policy.

Where an acceptance checkbox is displayed during checkout, submitting an order after checking the box confirms that the customer has read and agreed to the applicable terms.

Nothing in these Terms limits any consumer, privacy or other rights that cannot lawfully be waived or restricted under Israeli law. In the event of a conflict between these Terms and mandatory law, mandatory law shall prevail.

2. Definitions

“TATADOLLS” or “the Business” means the business operated by Ouliana Spynou.

“User” means any person visiting or using the Website.

“Customer” means a User who places an order or provides information for the purpose of purchasing a product.

“Physical Product” means a tangible product offered for direct purchase through the Website.

“Handmade Product” means a product produced or finished substantially by hand.

“Custom Product” means a product manufactured specifically according to special measurements, personalisation or requirements supplied by a particular customer.

“Order” means a request to purchase one or more products through the Website.

“Content” includes text, photographs, videos, graphics, illustrations, logos, designs, product descriptions, pattern previews and other materials appearing on the Website.

3. Eligibility to Use the Website and Purchase Products

A purchase may be made by a person who has legal capacity to enter into a binding transaction and who is authorised to use the selected payment method.

A minor or a person requiring the consent of a legal representative may purchase only with the consent required by law.

The customer must provide accurate, complete and current information.

TATADOLLS may decline or cancel an order where reasonably necessary, including where payment has not been authorised; information supplied is materially incorrect or incomplete; there is reasonable suspicion of fraud or unauthorised use of a payment method; the product is unavailable; an obvious and material pricing or product-description error occurred; or completing the order would violate applicable law.

If payment has already been collected in relation to an order that cannot be fulfilled, the relevant amount will be refunded in accordance with applicable law and the payment method used.

4. User Accounts

Certain Website functions may allow or require a customer to create a user account.

An account may enable the user to view orders, manage contact information and use other Website features.

The user is responsible for providing accurate account information, keeping login credentials and passwords confidential, preventing unauthorised use of the account and notifying TATADOLLS if unauthorised access is suspected.

TATADOLLS may restrict or suspend an account where reasonably required for security, prevention of fraud, unlawful use of the Website or a material violation of these Terms.

Closing an account does not necessarily require immediate deletion of information that must or may legitimately be retained for accounting, tax, transaction records, dispute resolution, fraud prevention, legal claims or compliance with law.

5. Handmade Products and Product Information

TATADOLLS takes reasonable care to describe and photograph its products accurately.

Because many TATADOLLS products are handmade, minor differences may naturally occur between individual items. Such differences may include slight variations in embroidery or facial details, placement of printed fabric patterns, minor differences in stitching, slight variations in shape or measurements, positioning of handmade decorative details and other minor characteristics inherent in handmade production.

These natural variations do not affect the customer’s statutory rights where a product is defective or materially different from what was ordered or represented.

Colours may appear differently depending on the customer’s screen, display settings, lighting and device.

Where exact dimensions are important, the customer should review the measurements provided in the relevant product description before ordering.

Props, furniture, decorative objects and other items shown in photographs are not included unless expressly stated in the product description.

6. Product Safety and Intended Use

Customers must follow all age recommendations, safety instructions, care instructions and warnings provided with or in relation to a product.

Products intended for children must be used in accordance with their stated purpose and age suitability.

Adult supervision must be provided where required by the product, its age recommendation or applicable safety instructions.

A product should not continue to be used if it becomes torn, damaged, excessively worn or if any component becomes loose or detached in a manner that may create a safety risk.

Nothing in this section limits TATADOLLS’ responsibility for a defect, non-conformity or other liability that cannot lawfully be excluded.

Where mandatory Israeli product-safety requirements or standards apply to a particular product, TATADOLLS will act in accordance with the applicable requirements.

7. Prices

The price applicable to an order is the price displayed on the Website when the order is submitted, subject to correction of an obvious material error.

The final amount payable will be shown before the customer confirms payment.

Delivery charges, where applicable, will be shown separately or calculated during checkout unless expressly stated to be included in the product price.

TATADOLLS may change prices, promotions, discounts or sales conditions from time to time.

A later price change will not affect an order that has already been confirmed, except where required to correct an obvious material error and subject to applicable law.

8. Promotions and Discount Codes

Promotions and discount codes may be subject to specific conditions displayed with the relevant offer.

Unless otherwise stated, promotions are valid only during the stated period, discount codes cannot be exchanged for cash, discounts cannot necessarily be combined, a discount applies only to eligible items and TATADOLLS may correct an obvious technical error affecting a promotion.

Nothing in this section permits TATADOLLS to alter an already confirmed transaction contrary to applicable law.

9. Availability and Stock

The appearance of a product on the Website does not guarantee that it remains available at all times.

If a product becomes unavailable after an order has been submitted, TATADOLLS may contact the customer and offer, as appropriate, a reasonable waiting period, an alternative product, an agreed modification of the order, cancellation of the unavailable product or cancellation of the relevant order and refund.

A substitute product will not be supplied without the customer’s agreement.

10. Placing and Confirming an Order

During checkout, the customer may be asked to provide information including full name, telephone number, email address, billing information, shipping address, product selections and other information necessary to fulfil the order.

The customer is responsible for the accuracy of the information provided.

An incorrect or incomplete address may cause delay, failure of delivery or additional delivery costs.

An order will normally be regarded as confirmed after the checkout process has been completed, the payment has been successfully authorised and an order confirmation has been issued by TATADOLLS.

An automated acknowledgement that an order has been received does not override a payment failure, lack of availability, obvious material error or other circumstance that lawfully prevents fulfilment.

Customers should review the order confirmation and notify TATADOLLS promptly if they identify an error.

11. Payment

Payment may be made using the payment methods displayed on the Website at checkout.

Payments may be processed by external payment processors, credit-card companies, banks or other payment-service providers.

The provider may require additional verification before approving a transaction.

The total amount payable will be displayed before the customer confirms the transaction.

TATADOLLS does not store full credit-card details where those details are entered directly into and processed through the systems of the payment provider.

Payment processing is also subject to the technical procedures and applicable terms of the relevant provider.

12. Custom and Personalised Orders

If TATADOLLS offers a product manufactured specifically according to special measurements or individual requirements requested by a customer, the customer is responsible for checking all information supplied before production begins.

This may include spelling of a name, selected colours or fabrics, special dimensions, requested personalisation and other individual specifications.

TATADOLLS may contact the customer for clarification before production begins.

Changes requested after production has begun are not guaranteed and may involve additional cost where permitted by law and agreed with the customer.

Cancellation rights concerning products manufactured specifically according to special measurements or requirements of the customer will be determined in accordance with Israeli law and the separate Shipping & Returns Policy.

The fact that an item is handmade does not, by itself, mean that statutory cancellation rights do not apply.

Nothing in this section limits the customer’s rights in the event of a defect, non-conformity or error by TATADOLLS.

13. Shipping, Collection, Cancellations and Returns

Detailed information concerning order preparation times, shipping methods, shipping costs, delivery estimates, international delivery if available, collection in person if available, order cancellation, returns, exchanges, defective or incorrect products and refunds is provided in the separate Shipping & Returns Policy published on the Website.

The Shipping & Returns Policy forms an integral part of these Terms.

Cancellation and return rights will at all times be subject to the mandatory provisions of Israeli consumer law.

Where required by law, TATADOLLS will provide appropriate methods for submitting a cancellation notice, including an online method where applicable.

Certain categories of consumers may have extended cancellation rights where the conditions prescribed by Israeli law are met.

14. PDF Sewing Patterns and Etsy

The Website may display photographs, descriptions, previews, articles or links relating to TATADOLLS PDF sewing patterns.

Unless expressly stated otherwise, PDF sewing patterns are not purchased, paid for, downloaded or digitally delivered through the TATADOLLS Website.

A button or link to purchase a PDF pattern may redirect the user to the TATADOLLS shop on Etsy.

A transaction completed on Etsy is processed through the Etsy platform and is also subject to the terms and policies of Etsy, the policies of the TATADOLLS Etsy shop, the terms displayed in the relevant Etsy listing and applicable law.

TATADOLLS remains responsible for its obligations as the seller of its own patterns to the extent required by applicable law.

Etsy is responsible for the operation of its own platform, payment infrastructure and other services provided directly by Etsy.

Questions concerning a specific Etsy order should be handled through the contact method specified for that order or through the Etsy platform.

15. Intellectual Property

Unless otherwise indicated, intellectual-property rights in original Website Content belong to TATADOLLS or are used with lawful permission.

Protected Content may include the TATADOLLS name and branding, original product photography, Website photographs and videos, texts and product descriptions, graphics and illustrations, original doll designs to the extent protected by law, sewing-pattern previews, tutorials and creative content and the original presentation and arrangement of Website materials.

Users may view the Website for personal and lawful purposes.

No Website Content may be copied, reproduced, republished, sold, commercially distributed, adapted, translated or used to create commercial derivative material without prior permission where such use infringes applicable intellectual-property rights.

Sharing a link to a publicly accessible page is permitted provided that the sharing is not misleading and does not falsely suggest sponsorship or affiliation.

The purchase of a physical product does not transfer copyright or other intellectual-property rights in the design, photographs, patterns or Website Content.

Rights and licence terms relating to PDF sewing patterns purchased through Etsy are governed by the relevant Etsy listing and applicable shop terms.

TATADOLLS may take reasonable technical or administrative measures to protect the Website and its users.

17. External Websites and Services

The Website may contain links, embedded functions or services provided by third parties, including, where applicable, Etsy, Instagram or other social networks, payment processors, delivery providers, hosting providers, email services, analytics services and other technical providers.

TATADOLLS does not control the independent operation, security or privacy practices of third-party platforms.

When a user leaves the Website or uses an external service, the terms and privacy policy of the relevant third party may also apply.

18. Website Availability

TATADOLLS takes reasonable steps to maintain the Website but cannot guarantee uninterrupted or error-free availability.

Temporary interruptions may occur because of maintenance, software updates, hosting failures, internet or communications failures, payment-system failures, security incidents or circumstances outside the reasonable control of TATADOLLS.

A delay or failure caused by circumstances outside the reasonable control of TATADOLLS may include, among other things, war or security events, instructions of the Home Front Command or another competent authority, natural disasters, extreme weather, strikes, epidemic or public-health restrictions, closure of roads or areas, exceptional disruption of delivery services, disruption of payment, communications or internet systems or other comparable events beyond reasonable control.

TATADOLLS will take reasonable steps to inform affected customers and address confirmed orders in accordance with the circumstances and applicable law.

Nothing in this section removes mandatory consumer rights.

20. General

TATADOLLS respects the privacy of Website users and processes personal information in accordance with applicable Israeli privacy law, including the Protection of Privacy Law, 5741–1981, as amended, and applicable data-security regulations.

For purposes of personal information processed through the Website, the person responsible for the business and the relevant controller is Ouliana Spynou / TATADOLLS.

“Personal information” generally means information relating to an identified person or a person who can reasonably be identified.
